UK Entrepreneur Visas

Our expert immigration law barristers can help you enter the UK for the purpose of establishing, taking over or becoming a director of one or more businesses in this country under the Tier 1 Entrepreneur route. By providing guidance and taking a strategic approach to any immigration matter, we can help you successfully navigate the UK’s complex immigration rules and laws.

Entrepreneurs: Tier 1 Visas

The Tier 1 (Entrepreneur) visa is available for anyone who wishes to establish, join or take over one or more businesses in the UK.  You must have access to not less than £200,000 or access to £50,000 if the funds are from:

  • One or more registered venture capital firms registered with the Financial Conduct Authority (FCA);
  • One or more UK Entrepreneurial seed funding competitions which is listed as endorsed on the UK Trade & Investment website; or
  • One or more UK Government Departments, or Devolved Government Departments in Scotland, Wales or Northern Ireland and made available by the Department(s) for the specific purpose of establishing or expanding a UK business.

UK Visas and Immigration will also want to establish whether you’re a genuine entrepreneur.

From 11 July 2014 this Route has been the subject of significant further restrictions, targeted at migrants who have only been active in certain limited work for others (particularly administration, marketing or website functions) or who cannot establish  that they have been offering core services that exceed NQF level 4 or above. Even before these restrictions, the Rules permitted decision makers to take a close look at the viability and credibility of these applications, including at the source of the money, business plans and market research, previous educational and business experience (or lack thereof), and any relevant immigration history and previous activity in the UK.  If applying for entry clearance you may find that your business plans are derailed because an Entry Clearance Officer conducts an informal management consultancy exercise in which they criticise your market research, ability to recall details of the business plan at interview, fact-finding investigations into the business’s viability and assessment of the competition.

Applications can go wrong for all kinds of other reasons too: investigations may query the source of funds relied upon; documents you sent with your application may have been misunderstood or overlooked; or technical points may be raised based on a particular document not complying with the relevant Rule, such as a contract not showing the required names.

We can give you fast, pragmatic advice on whether there are arguments available which will help you overcome any problems.

Skilled Migration takes a strategic and co-ordinated approach to the UK’s immigration rules, whether you are applying for a Tier 1 (Entrepreneur) visa for the first time, want to switch visa categories or looking for your dependants to join you.
